4. Orders and Payment

4.1 Product Availability

All products listed on the Website are subject to availability. Recovery and Strength sources and fulfills products through manufacturer and supplier partners on our behalf. We reserve the right to limit quantities of any products or services we offer and cannot guarantee availability of any specific item at any given time.

4.2 Pricing and Shipping Costs

Prices for our products are subject to change without notice. Outbound shipping rates are as follows:

  • Orders over $100: Free standard shipping
  • Orders under $100: $60 flat-rate standard shipping

We are not liable for any price changes, modifications, or discontinuance of products.

4.3 Order Cutoff Time

Orders placed before 2:00 PM PST on a business day (Monday through Friday, excluding federal holidays) will begin processing that same day. Orders placed after 2:00 PM PST, on weekends, or on federal holidays will begin processing on the next business day. Actual delivery times depend on your location and the fulfillment partner handling your order.

4.4 Payment Terms

  • Accepted Payment Methods: Visa, Mastercard, American Express, PayPal, and other methods available at checkout
  • Payment Processing: Payments are processed securely through Shopify Payments. We do not store your full payment card details.
  • Billing Information: You agree to provide current, complete, and accurate billing information

4.5 Order Acceptance

We reserve the right to refuse or cancel any order for reasons including but not limited to:

  • Product or service availability
  • Errors in the description or price of the product
  • Suspected fraudulent or unauthorized transactions

5. Shipping and Delivery

Recovery and Strength partners with manufacturers and suppliers who fulfill and ship orders on our behalf. Delivery timelines may vary depending on the fulfillment partner, product type, and your delivery location. 5.2 Risk of Loss

All purchases are made pursuant to a shipment contract. Risk of loss and title for items pass to you upon our delivery to the carrier. Recovery and Strength is not responsible for delays, losses, or damages that occur after the order has been handed to the carrier.

6. Returns and Refunds

Returns, exchanges, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. Key terms include:

  • Return window: 30 days from delivery
  • Damage reporting: Must be reported within 7 days of delivery
  • Return shipping: Customer responsibility unless item is defective, damaged, or incorrect
  • Restocking fee: 25% for approved non-defective returns
  • Cancellations: Must be requested before 2:00 PM PST on the same business day the order was placed

The products available through Recovery and Strength — including infrared saunas, cold plunge systems, float tanks, red light therapy panels, and fitness equipment — are intended for general wellness, recovery, relaxation, and performance support purposes only, unless expressly stated otherwise on the product page.

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Santa Barbara County, California for the resolution of any disputes not subject to arbitration.

16. Dispute Resolution

16.1 Informal Resolution

If a dispute arises between you and Recovery and Strength, both parties agree to first attempt to resolve the matter informally. Please contact our support team at support@recoveryandstrength.com within 30 days of the issue arising. We will make a good-faith effort to resolve the dispute within that timeframe.

16.2 Binding Arbitration

If the dispute cannot be resolved through informal means, both parties agree that the dispute will be settled through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration will take place in Santa Barbara, California, and the decision of the arbitrator will be final and binding on both parties.

16.3 Class Action Waiver

You agree that any dispute will be resolved individually and not as part of any class action, consolidated, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16.4 Exceptions

Either party may bring a claim in small claims court if the claim qualifies, or seek injunctive or other equitable relief in a court of competent jurisdiction for alleged infringement or misuse of intellectual property rights.
